General Terms and Conditions Tamazirt Reizen

    Applicability

    1. These terms and conditions apply to all services offered by Tamazirt Reizen, including accommodations, excursions, and tours in Morocco.
    2. The outbound and return travel to and from Morocco, as well as travel to the starting point of the services (insofar as not organized by Tamazirt Reizen), are not part of the services. Tamazirt Reizen accepts no responsibility for these arrangements.

    Conclusion of the Agreement

    1. An agreement is established as soon as the booking is confirmed by Tamazirt Reizen via email.
    2. The customer will receive an overview of the services and the total price.

    Payment

    1. When booking a trip, a deposit of 30% is required.
    2. The remaining amount must be paid in full no later than 4 weeks before the start of the trip.
    3. If payment is not made on time, Tamazirt Reizen reserves the right to cancel the agreement.
    4. For reservations at Gite Tamazirt or Gite La Tulipe, payment is made in cash directly at the gîtes. For group bookings of 6 or more people and/or multiple nights, a deposit of 30% of the total booking amount may be requested.

    Prices

    1. All prices are communicated in advance.
    2. Included and excluded costs are clearly specified.
    3. Any local taxes, entrance fees, and tips are - unless stated otherwise - at the customer’s expense.

    Provision of Services

    1. Tamazirt Reizen provides only the services as specified in the confirmation.
    2. The customer is required to follow the instructions of guides or representatives of Tamazirt Reizen.
    3. Participation in activities is at the customer’s own risk.

    Insurance

    1. The customer is personally responsible for holding valid travel and health insurance with coverage in Morocco.

    Changes by the Customer

    1. Changes after confirmation are only possible insofar as circumstances allow.
    2. Any additional costs from third parties are entirely at the customer’s expense.

    Cancellation by the Customer

    In case of cancellation, the following fees apply:

    • up to 30 days before departure: 30% of the travel sum
    • 29 to 15 days before departure: 50% of the travel sum
    • 14 to 7 days before departure: 75% of the travel sum
    • less than 7 days before departure or in case of no-show: 100% of the travel sum

    Changes or Cancellation by Tamazirt Reizen

    1. Tamazirt Reizen may modify the trip if necessary due to circumstances beyond its control (e.g. weather conditions, safety concerns, force majeure).
    2. If possible, a suitable alternative of comparable value will be offered.
    3. If this is not feasible, the customer is entitled to a refund of (part of) the travel sum.
    4. Tamazirt Reizen is not liable for additional costs outside the agreed services, such as flights or transportation to Morocco.

    Force Majeure

    1. Force majeure refers to circumstances that prevent the execution of the agreement and cannot be attributed to Tamazirt Reizen, such as natural disasters, political unrest, strikes, or government measures.
    2. In the event of force majeure, Tamazirt Reizen is not liable for damages or additional costs.

    Liability

    1. Tamazirt Reizen’s liability is limited to direct damages resulting from the services it organizes.
    2. Tamazirt Reizen is not liable for accidents, loss, or damage occurring outside its direct organization, including incidents during the outbound or return journey to Morocco.
    3. The customer remains personally responsible for their belongings.

    Complaints

    1. Complaints during the trip must be reported immediately to Tamazirt Reizen or its local representative, so that a solution can be sought.
    2. If a complaint is not satisfactorily resolved on site, the customer must submit it in writing no later than 14 days after the end of the trip.

    Applicable Law and Competent Court

    1. All agreements between Tamazirt Reizen and the customer are governed exclusively by Dutch law.
    2. Disputes should preferably be resolved through mutual consultation. If this is not possible, disputes will be submitted to the competent court in the Netherlands.
    3. If the customer is a consumer residing outside the Netherlands, they may also, under mandatory law, initiate proceedings before the competent court in their country of residence.
